1. Acceptance of Terms

By accessing or using Linganisa (the "Service"), operated by Planetary Escape Pvt Ltd ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We may update these Terms from time to time. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.

2. Description of Service

Linganisa is a virtual try-on service that uses artificial intelligence to generate images showing how clothing and other products might look on you. The Service includes:

  • Uploading and managing your photos
  • Extracting product images from e-commerce websites
  • Generating AI-powered virtual try-on images
  • Saving and organizing your try-on history

The Service is available through our website, mobile applications, and browser extension.

3. Account Registration

To use Linganisa, you must:

  • Be at least 13 years old. If you are under 18, you must have your parent or guardian's permission to use the Service.
  • Provide accurate information. You agree to provide truthful and current information when creating your account.
  • Maintain account security. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You may terminate your account at any time through the app settings. We may suspend or terminate your account if you violate these Terms.

4. Your Content

4.1 Ownership

You retain ownership of the photos you upload. By uploading photos to Linganisa, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and process your photos solely for the purpose of providing the Service to you.

4.2 Your Responsibilities

You represent and warrant that:

  • You have the right to upload any photos you submit, including obtaining consent from any individuals pictured.
  • Your photos do not infringe on any third party's intellectual property rights, privacy rights, or other legal rights.
  • Your photos do not contain illegal, harmful, or objectionable content.

4.3 AI-Generated Content

Try-on images generated by Linganisa are provided for your personal use. You may:

  • Share generated images on social media for personal purposes
  • Use generated images to help make purchasing decisions

You may NOT:

  • Use generated images to train other AI models without our written permission
  • Sell or commercially redistribute generated images
  • Use generated images to deceive others or misrepresent yourself
  • Use generated images in ways that infringe on third-party rights

5. Acceptable Use

When using Linganisa, you agree NOT to:

  • Upload harmful content: No pornographic, explicit, violent, hateful, or illegal content.
  • Violate others' rights: Do not upload photos of others without their consent.
  • Impersonate others: Do not use the Service to create misleading or deceptive content.
  • Abuse the Service: Do not attempt to circumvent usage limits, reverse engineer the Service, or interfere with its operation.
  • Spam or automate: Do not use bots or automated methods to access the Service.
  • Violate laws: Do not use the Service for any illegal purpose.

We reserve the right to remove content and terminate accounts that violate these guidelines.

6. Credits and Payments

Linganisa offers free generations with limited credits. Additional credits or premium features may be available for purchase.

  • Free Credits: New users receive a limited number of free generation credits.
  • Purchased Credits: Additional credits may be purchased. All purchases are final and non-refundable unless required by law.
  • Credit Expiration: Purchased credits do not expire. Free credits may expire as specified in the app.

Prices and credit policies may change at any time. We will notify you of significant changes.

7. Intellectual Property

The Linganisa name, logo, website, applications, and all related content (excluding user-submitted content) are owned by Planetary Escape Pvt Ltd and protected by intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service or its content without our prior written consent.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We disclaim all warranties, express or implied, including:

  • Warranties of merchantability and fitness for a particular purpose
  • Warranties that the Service will be uninterrupted or error-free
  • Warranties regarding the accuracy or reliability of AI-generated images

AI-generated try-on images are approximations and may not accurately represent how products will look in real life. We do not guarantee that virtual try-ons will match actual product fit, color, or appearance.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLANETARY ESCAPE PVT LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $500 USD.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless Planetary Escape Pvt Ltd and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you upload or share through the Service

11. Termination

By You: You may terminate your account at any time by deleting your account through the app settings.

By Us: We may suspend or terminate your account:

  • Immediately if you violate these Terms
  • With 30 days' notice for any other reason

Upon termination, your right to use the Service ceases immediately. Your uploaded content and generated images may be permanently deleted.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Planetary Escape Pvt Ltd is incorporated, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.

13. Miscellaneous

  • Entire Agreement: These Terms constitute the entire agreement between you and us regarding the Service.
  • Severability: If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
  • No Waiver: Our failure to enforce any provision of these Terms does not waive our right to do so in the future.
  • Assignment: We may assign our rights and obligations under these Terms. You may not assign your rights without our consent.
